The City Council has engaged in various discussion over the years regarding the potential establishment and operation of marijuana dispensaries. The most recent discussion occurred in May 2017 and culminated in a unanimous vote to prohibit marijuana dispensaries. By that same vote, the City Council also directed staff to “agendize a City Council discussion of potential regulations permitting the establishment, location, and operation of medical and/or non-medical marijuana dispensaries should Federal laws change such that marijuana is no longer a Schedule 1 controlled substance under the Controlled Substances Act.” At the regular meeting on May 20, 2020 – acting on a recommendation made by Mayor Pro Tem Horne – the City Council voted 3-2, with Mayor Hatch and Councilmember Moore dissenting, to direct the City Manager to draft the resolutions necessary to include an advisory vote on the November 3, 2020 ballot to solicit voter opinions on the potential authorization of marijuana dispensaries in commercial zoning districts for future consideration by the City Council. Today’s meeting is an opportunity for City Council action, as well as public input, on resolutions that, if adopted, would take actions necessary to include a marijuana dispensaries advisory vote on the November 3, 2020 ballot. Pursuant to California Elections Code Section 9603, the results of such an advisory vote would not be controlling on the City Council. 

As drafted, the question posed to voters would read: 

“ADVISORY VOTE ONLY 

Should the City of Laguna Woods allow the establishment and operation of marijuana dispensaries offering the retail sale of medical and non-medical marijuana in commercial zoning districts within the City of Laguna Woods city limits?” 

If the City Council wishes to proceed with a marijuana dispensaries advisory vote, it would also need to determine whether to write arguments for or against the ballot measure, or authorize one or more of its members to do so. If the City Council does not wish to write arguments or authorize its members to do so, staff would solicit arguments, with preference and priority given, in the order named, to arguments of the following (California Elections Code Section 9287):

1. Bona fide associations of citizens. 

a. Must submit a copy of one of the following: 

  .  Its articles of incorporation, articles of association, partnership documents, bylaws, or similar documents. 


  .  Letterhead containing the name of the organization and its principal officers. 


  .  If the organization or association is a primarily formed committee established to support or oppose the measure, its statement of organization filed pursuant to California Government Code Section 84101. 


2. Individual voters who are eligible to vote on the measure
